OPT and the Sponsorship Question: What to Clarify with Employers

Read current and future sponsorship questions carefully, explain time-limited OPT authorization, and confirm STEM OPT employer responsibilities before relocation.

Read the exact application question. “Are you authorized to work now?” and “Will you now or in the future require sponsorship?” ask different things. Describe your actual authorization and future needs accurately; if you expect an employer-sponsored status to continue after OPT, disclose that when asked about future sponsorship. Ask the recruiter for clarification if the form combines several questions or offers no explanation field.

OPT authorization is time-limited. Do not present a possible STEM extension or a future visa petition as already approved. Immigration forms, a job offer, and an employer's hiring policy serve different purposes.

Confirm before accepting or relocating

  • What work authorization and expiration date will HR use for onboarding?
  • Does the employer accept applicants on your current OPT category?
  • If you plan a STEM extension, will the employer review its eligibility and complete the required training plan?
  • Who is responsible for immigration questions: recruiter, HR, or the employer's counsel?
  • Is future sponsorship available, unavailable, or undecided? Get the answer in writing.
  • Is the offer conditional on authorization verification? What relocation expenses are covered if a condition is not met?

The last two items are contract and policy questions. A lease or completed move does not itself change an employer's immigration policy.

STEM OPT requires employer participation

Eligible STEM employment requires an employer participating in E-Verify and a training arrangement that meets the applicable requirements. The student and employer complete and sign Form I-983 for the DSO. An offer letter does not replace that plan. Recruiter message

Hello [recruiter],

Before we proceed, I would like to clarify my work authorization. I currently hold [OPT/STEM OPT authorization or pending application], with [actual approved dates, or state that approval is pending]. My ability to start depends on completing the applicable authorization and onboarding requirements.

For continued employment beyond this authorization, I [expect to need employer sponsorship / would like to discuss my circumstances]. If a STEM OPT extension is part of the plan, can HR confirm E-Verify participation and willingness to complete and support Form I-983?

Please confirm that this fits the position’s hiring policy and clarify how I should answer the application’s current/future sponsorship question.

If you already answered a question incorrectly

Contact the recruiter promptly, explain the misunderstanding, and provide a corrected description. Keep the exchange. Do not wait until onboarding to reveal an authorization limit you already know about. Your employer's decision and any dispute depend on the facts and applicable law; seek individual advice if an offer is withdrawn.
